Chapter 2.01 — City Council

§ 2.01.010 Composition
The City Council shall consist of five (5) members elected by the registered voters of the City at large to serve staggered four-year terms as provided by state law. Council members shall serve without compensation unless otherwise established by resolution.
§ 2.01.020 Regular Meetings
The City Council shall hold regular meetings on the first and third Tuesday of each month at 6:00 p.m. in the City Hall Council Chambers, 100 City Hall Plaza, McLainberg. If any regular meeting falls on a legal holiday, the meeting shall be held on the next succeeding business day at the same time and place.
§ 2.01.030 Special Meetings
Special meetings of the City Council may be called at any time by the Mayor or by a majority of the Council members. Notice of a special meeting shall be given to each Council member and to each local newspaper of general circulation at least twenty-four (24) hours before the time of such meeting as specified in the Brown Act (Government Code § 54956).
§ 2.01.040 Quorum
Three (3) members of the City Council shall constitute a quorum for the transaction of business. The affirmative vote of at least three (3) members shall be required for the adoption of any ordinance, resolution, or motion, except that the number required by state law for a specific action shall control.
§ 2.01.050 Rules of Order
The City Council shall adopt rules of procedure for the conduct of its meetings. Robert's Rules of Order, as revised, shall govern proceedings of the City Council in all cases to which they are applicable and in which they are not inconsistent with the adopted rules or state law.
Chapter 2.02 — Mayor

§ 2.02.010 Selection and Term
The Mayor shall be elected by the registered voters of the City at-large to a two-year term. The Mayor shall preside at all meetings of the City Council and shall perform such other duties as may be required by this Code or by the City Council. In the absence or disability of the Mayor, the Mayor Pro Tempore shall perform the duties of the Mayor.
§ 2.02.020 Mayor Pro Tempore
The City Council shall, by majority vote, select one of its members to serve as Mayor Pro Tempore for a term of one (1) year. The Mayor Pro Tempore shall act as Mayor during the absence or disability of the Mayor.
Chapter 2.03 — City Manager

§ 2.03.010 Appointment
The City Council shall appoint a City Manager who shall be the chief administrative officer of the City. The City Manager shall be appointed on the basis of executive and administrative qualifications, with special reference to actual experience in and knowledge of accepted practices in respect to the duties of the office herein prescribed.
§ 2.03.020 Powers and Duties
The City Manager shall have the following powers and duties:
- Appoint, discipline, and remove all City department directors and employees, except the City Clerk, City Attorney, and City Treasurer, subject to the provisions of the personnel system;
- Direct and supervise the administration of all City departments, offices, and agencies, except as otherwise provided;
- Attend all City Council meetings and have the right to take part in discussion but not to vote;
- Prepare and submit the annual budget and capital program to the City Council;
- Keep the City Council fully advised as to the financial condition and future needs of the City;
- Make such other reports as the City Council may require;
- Enforce all laws, provisions of this Code, and acts of the City Council; and
- Perform such other duties as may be required by the City Council.
Chapter 2.04 — City Clerk

§ 2.04.010 Appointment and Duties
The City Clerk shall be appointed by the City Council and shall: keep the official records of the City Council; attest all official documents; maintain the seal of the City; publish notices required by law; administer oaths; keep the official copy of this Code; and perform such other duties as required by the City Council or state law.
§ 2.04.020 Public Records
The City Clerk shall maintain all official City records in accordance with the California Public Records Act (Government Code §§ 7920 et seq.) and the City's adopted records retention schedule. Requests for public records shall be directed to the City Clerk's Office.
Chapter 2.05 — City Attorney

§ 2.05.010 Appointment
The City Attorney shall be appointed by the City Council and shall serve as legal advisor to the City Council, City Manager, and all City departments, boards, and commissions. The City Attorney may be an individual attorney or a law firm retained by the City.
Chapter 2.06 — City Treasurer

§ 2.06.010 Appointment and Duties
The City Treasurer shall be appointed by the City Council. The City Treasurer shall receive and safely keep all City moneys, invest City funds pursuant to the City's Investment Policy, and render a quarterly investment report to the City Council as required by Government Code § 53646.
Chapter 2.07 — Boards, Commissions and Committees

§ 2.07.010 Establishment
The City Council may establish boards, commissions, and advisory committees to assist in the administration of City affairs. The following standing bodies are hereby established: Planning Commission; Parks and Recreation Commission; Finance Committee; and such other bodies as may be created by resolution or ordinance.
§ 2.07.020 Appointments
Members of boards, commissions, and committees shall be appointed by the City Council by majority vote. Members shall be residents of the City unless the City Council expressly waives this requirement for a specific body. Terms shall be as specified in the resolution or ordinance creating each body.
Chapter 2.08 — Personnel System

§ 2.08.010 Merit System
All City employees, except for the City Manager, City Clerk, City Attorney, City Treasurer, and other at-will positions expressly designated by the City Council, shall be employed and retained on the basis of merit and fitness as demonstrated by competitive examination or other qualifications-based evaluation.
§ 2.08.020 Personnel Rules
The City Council shall adopt Personnel Rules governing recruitment, selection, classification, compensation, benefits, discipline, grievance procedures, and other terms and conditions of City employment. Such rules shall be consistent with applicable state and federal law.
