Chapter 4.01 — Health and Sanitation

§ 4.01.010 Adoption of State Health Code

The City adopts by reference the California Health and Safety Code as it applies to local health and sanitation matters, including food safety, communicable disease prevention, and environmental health standards. The Health Officer shall administer these provisions within the City.

§ 4.01.020 Solid Waste Collection

Every owner, occupant, or person in charge of any residence or business in the City shall use the City's authorized solid waste collection service or an approved franchised hauler. Solid waste shall be stored in approved containers and placed at curbside no earlier than sunset the day before scheduled collection. Containers shall be retrieved by sunset on the day of collection.

§ 4.01.030 Prohibited Disposal

No person shall deposit, dump, or allow to accumulate garbage, refuse, or waste material on any public or private property within the City except in approved containers or at approved disposal facilities. Illegal dumping constitutes a misdemeanor and shall be subject to mandatory cleanup costs and administrative penalties.

Chapter 4.02 — Nuisances

§ 4.02.010 Public Nuisances Declared

The following conditions are declared to be public nuisances and are prohibited within the City:

  1. Any condition that endangers the life, limb, health, property, safety, or welfare of the public;
  2. Accumulation of junk, debris, rubbish, or waste material that is visible from a public right-of-way;
  3. Overgrown vegetation that constitutes a fire hazard or harbors vermin;
  4. Abandoned, inoperable, or unregistered vehicles stored on residential property in violation of Title 10;
  5. Graffiti or defacement of public or private property;
  6. Any structure or condition declared a nuisance under state law.

§ 4.02.020 Abatement Procedure

Upon a finding that a public nuisance exists, the Code Enforcement Officer shall issue a written notice to the responsible party requiring abatement within a period not less than ten (10) days. If the nuisance is not abated within the specified time, the City may abate the nuisance and recover the cost from the property owner as a lien on the property.

Chapter 4.03 — Hazardous Materials

§ 4.03.010 Hazardous Materials Business Plan

Any business that handles hazardous materials in quantities at or above threshold planning quantities established by the California Accidental Release Prevention (CalARP) Program shall file a Hazardous Materials Business Plan (HMBP) with the City Fire Department and the County Unified Program Agency. The HMBP shall be updated annually and upon any material change in operations.

§ 4.03.020 Underground Storage Tanks

All underground storage tanks within the City shall comply with the requirements of the State Water Resources Control Board's Underground Storage Tank Program and the City's adopted standards for secondary containment, monitoring, and leak detection.

Chapter 4.04 — Fire Prevention and Fireworks

§ 4.04.010 Adoption of California Fire Code

The City adopts by reference the California Fire Code (Title 19, California Code of Regulations) as currently adopted and as amended by the State Fire Marshal, together with the appendices and local amendments set forth in this chapter.

§ 4.04.020 Fireworks Prohibited

The sale, possession, use, or discharge of any fireworks within the City is prohibited. This prohibition applies to all fireworks, including those designated "Safe and Sane" under California state law. Violations are a misdemeanor and subject to fines as provided in the City's fee schedule. The Fire Chief is authorized to seize and destroy any fireworks found within the City in violation of this section.

§ 4.04.030 Defensible Space

All owners and occupants of improved property within State Responsibility Areas (SRA) and Very High Fire Hazard Severity Zones (VHFHSZ) within the City shall maintain a minimum 100-foot defensible space around all structures as required by Public Resources Code §§ 4291 and 51182 and the California Fire Code. The Fire Department shall conduct annual inspections in VHFHSZ areas.

Chapter 4.05 — Noise Control

§ 4.05.010 Noise Standards

No person shall create, cause, or allow to be created any sound that exceeds the following exterior noise level standards as measured at the property line of the affected property:

  1. Residential zones: 55 dBA (7:00 AM – 10:00 PM); 45 dBA (10:00 PM – 7:00 AM)
  2. Commercial zones: 65 dBA at all times
  3. Industrial zones: 70 dBA at all times

§ 4.05.020 Construction Activity

Construction activity, including grading, demolition, and equipment operation, shall not occur between 7:00 PM and 7:00 AM on weekdays, or between 6:00 PM and 8:00 AM on weekends and holidays. Emergency repair work authorized by the City Manager is exempt from these restrictions.
