Section 4.5 — Temporary Uses

DC 4.5.1 Temporary Use Permit

Temporary uses that are not listed as permitted or conditional in the applicable district may be authorized for a limited time by a Temporary Use Permit (TUP) issued by the Planning Director. Temporary uses shall not exceed ninety (90) consecutive days and may not recur at the same location more than twice per calendar year without a CUP. Examples of temporary uses include: seasonal sales lots (Christmas trees, pumpkins); outdoor festivals and markets; construction trailers; and temporary housing during disaster recovery.

Section 4.6 — Home Occupations

DC 4.6.1 Standards for Home Occupations

Home occupations are permitted as an accessory use in all residential zoning districts subject to the following standards:

  1. The home occupation shall be clearly incidental and secondary to the residential use of the dwelling.
  2. No non-resident employee shall work at the residence in connection with the home occupation.
  3. No customers or clients shall visit the residential property in connection with the home occupation, except for no more than two (2) clients per day by appointment only.
  4. No exterior alteration of the dwelling shall occur that would indicate the conduct of a home occupation.
  5. No signage advertising the home occupation shall be displayed on the property, except for one non-illuminated nameplate not exceeding two (2) square feet.
  6. No merchandise, goods, or equipment related to the home occupation shall be stored outside the structure or visible from the public right-of-way.
  7. The home occupation shall not generate traffic, parking demand, noise, vibration, glare, fumes, odors, or other impacts beyond those normally associated with residential use.

Section 4.7 — Accessory Dwelling Units (ADUs)

DC 4.7.1 Authority and Purpose

Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs) are authorized by Government Code §§ 65852.2 and 65852.22 and are permitted in all residential zoning districts. The City recognizes ADUs as a valuable source of affordable housing and shall process all ADU applications ministerially, without discretionary review or public hearing, within sixty (60) days of a complete application.

DC 4.7.2 ADU Standards

ADUs shall comply with the following objective standards, except where state law requires a lesser standard:

  1. Maximum Size: Detached ADUs shall not exceed 1,200 square feet. Attached ADUs shall not exceed fifty percent (50%) of the primary dwelling floor area or 1,200 square feet, whichever is less.
  2. Setbacks: ADUs shall comply with the setbacks of the underlying zoning district, except that newly constructed detached ADUs shall have a minimum four-foot rear and side setback.
  3. Height: Detached ADUs shall not exceed sixteen (16) feet in height, except that ADUs above a detached garage may be up to twenty-four (24) feet.
  4. Parking: No parking is required for ADUs located within one-half mile of a transit stop, within a historic district, or that are created from a converted existing structure.
  5. Architectural Compatibility: ADUs shall use exterior materials and architectural features compatible with the primary dwelling, in compliance with adopted design guidelines.

DC 4.7.3 Junior ADU (JADU) Standards

A Junior ADU (JADU) shall be no more than five hundred (500) square feet in size, shall be entirely contained within the existing or proposed primary dwelling, shall include an efficiency kitchen, and may share a bathroom with the primary dwelling. An owner-occupancy requirement applies to the parcel where a JADU is created.
